Terms & Conditions

Welcome to HYX (“we,” “us,” or “our”), operated by Use Case Labs Pvt. Ltd., based in India. These Terms & Conditions (“Terms”) govern your access to and use of the HYX mobile application, website, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

Eligibility and Account Registration
1. Eligibility
  You must be at least 18 years of age to use HYX. By using the Service, you represent that you meet this age requirement. If you are under the legal age of majority, a parent or guardian must review and agree to these Terms on your behalf.
2. Account Creation
  To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated.
3. Account Security
  You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately at support@hyxpro.com if you suspect unauthorised use.
Fitness and Data Usage
1. Data Ownership
  You retain ownership of all fitness and performance data you upload or log within HYX. By using the Service, you grant HYX a non-exclusive, worldwide, royalty-free licence to process, analyse, and display your data as necessary to operate and improve the Service.
2. Data Accuracy
  You are responsible for ensuring the accuracy and completeness of any data you input or upload. HYX is not responsible for errors, omissions, or inaccuracies in user-provided data.
3. Data Retention and Deletion
  We store your data as long as your account is active or as required by law. You may request deletion of your data by contacting support@hyxpro.com.
4. Data and Usage
  Your use of HYX may generate activity logs, usage statistics, and performance insights. Please refer to our Privacy Policy for full details on how we collect, use, and store data.
Workout Logging, AI Insights, and Estimates
1. Informational Use Only
  All metrics, including estimated volume load, training insights, performance trends, or one-rep max calculations, are computational estimates derived from your logged data and other inputs you provide within the app. HYX uses algorithmic models and heuristic methods based on generally accepted principles in strength and conditioning, such as progressive overload, load–volume relationships, and perceived exertion frameworks.
  These outputs are intended to help users monitor trends and inform training decisions, but they are not clinical or diagnostic assessments and should not be treated as precise physiological measurements.
  Actual performance, recovery, and adaptation can vary widely based on factors such as technique, nutrition, sleep, stress levels, and individual variability. Accordingly, all estimates, projections, and insights are provided for informational and educational purposes only and should be interpreted as approximations rather than factual representations of your physical capacity or health status.
  HYX does not guarantee the accuracy, completeness, or applicability of any estimated data, and no part of the Service constitutes medical, therapeutic, or professional fitness advice.
  You should always exercise discretion and consult a qualified medical or fitness professional before acting on any information generated by the app.
2. AI-Generated Insights
  HYX may use AI to suggest workouts, analyse trends, or estimate fitness performance. AI-driven predictions may not accurately reflect your abilities. Verify all AI insights with professional guidance before making health or training decisions.
3. User Responsibility
  Exercise involves inherent risks. By using HYX, you assume full responsibility for any injuries, damages, or health issues arising from your use of the app or following any suggestions, metrics, or insights.
User-Generated Content
You retain ownership of the notes, workouts, and content you create (“User Content”). By submitting content, you grant HYX a non-exclusive, worldwide, royalty-free licence to use, modify, reproduce, and display it as part of the Service.
Subscriptions, Pricing & Billing
1. Subscription Services
  HYX may offer paid subscription plans that provide access to additional features, content, or functionality (“Subscriptions”). Subscription features, pricing, and availability may vary by region and are displayed within the app at the time of purchase.
  We reserve the right to modify, add, or remove subscription plans or benefits at any time, subject to applicable laws and platform requirements.
2. Pricing & Payment Processing
  All subscription purchases are processed through the Apple App Store using your Apple ID.
  - HYX does not collect, store, or process any payment or billing information, including credit card or bank details.
  - Payment information is handled entirely by Apple in accordance with Apple’s terms and privacy policies.
  - Prices are inclusive of applicable taxes unless otherwise stated by Apple.
3. Auto-Renewal Terms
  Unless cancelled, subscriptions automatically renew at the end of each billing period at the then-current subscription price.
  Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period.
  By purchasing a subscription, you acknowledge and agree to these auto-renewal terms.
4. Managing & Cancelling Subscriptions
  You may manage or cancel your subscription at any time through your Apple ID account settings:
  - Open Settings on your device
  - Tap your Apple ID
  - Select Subscriptions
  - Choose HYX and manage or cancel
  Cancellation takes effect at the end of the current billing period. No refunds or partial refunds are provided for unused time unless required by law.
5. Free Trials (If Applicable)
  HYX may offer free trial periods for certain subscriptions. If a free trial is offered:
  - It will automatically convert into a paid subscription unless cancelled before the trial ends.
  - Trial eligibility and duration are determined by Apple.
  - Only one free trial may be available per Apple ID, where permitted by Apple’s policies.
6. Refund Policy
  Refunds are managed exclusively by Apple, not HYX.
  HYX does not have the ability to issue refunds or credits for subscriptions purchased through the App Store. Any refund requests must be submitted through Apple’s official support channels and are subject to Apple’s refund policies.
7. Subscription Access & Changes
  If a subscription expires or is cancelled, access to subscription-only features will be disabled at the end of the billing period.
  HYX may modify subscription features, content, or benefits from time to time. Changes will not retroactively remove access during an active paid period unless required for legal, security, or operational reasons.
Acceptable Use
You agree to use HYX in compliance with all applicable laws and regulations. You must not:
- Upload, post, or transmit harmful code, viruses, malware, or spam.
- Harass, threaten, intimidate, or impersonate others.
- Interfere with or disrupt the Service, servers, or networks.
- Violate intellectual property rights or redistribute content without authorisation.
- Engage in illegal activities through the Service.
HYX may suspend or terminate accounts engaged in prohibited activity.
Gamification and Leaderboards
If HYX includes streaks, leaderboards, badges, or challenges:
- You agree to participate fairly and not manipulate data.
- HYX may remove or reset scores if cheating or data manipulation is detected.
Rewards or recognition programmes are subject to change or discontinuation without notice.
Fitness Safety and Medical Disclaimer
1. Not Medical Advice
  HYX is not a healthcare or medical service provider. All data, insights, analytics, and recommendations available within the app are intended solely for informational and educational purposes.
  Nothing provided through HYX should be interpreted as medical advice, diagnosis, treatment, or prescription. You should consult a qualified healthcare or fitness professional before beginning, modifying, or ceasing any exercise, nutrition, or wellness programme, especially if you have existing health conditions or concerns.
2. Nature of Estimates and Methodology
  The performance metrics, including training volume load, one-rep max estimates, intensity recommendations, and recovery insights, are computational estimates generated using algorithms that apply commonly accepted principles in strength training and exercise science.
  While these models are designed to reflect best practices and general training concepts, they are not individualised clinical assessments. Variations in physiology, technique, fatigue, and recovery mean actual responses can differ significantly from the app’s estimates.
  All outputs should therefore be understood as informational indicators, not as definitive measurements of capability, health, or performance.
3. User Responsibility and Assumption of Risk
  By using HYX, you acknowledge that physical exercise involves inherent risks, including the potential for injury, fatigue, or adverse health effects. You agree that you are solely responsible for your participation in any physical activity and that you will use HYX’s insights responsibly and within your own capacity.
  To the fullest extent permitted by law, Use Case Labs Pvt. Ltd. disclaims liability for any injuries, damages, or health complications arising from reliance on or use of HYX’s features, analytics, or recommendations.
Beta Features and Early Access
Beta or experimental features may be incomplete, unstable, or removed at any time. Continued availability is not guaranteed.
Feedback
Feedback, ideas, or suggestions may be used freely by HYX to improve the Service, without compensation or obligation.
Intellectual Property
All trademarks, logos, text, graphics, and proprietary elements are owned by Use Case Labs Pvt. Ltd. or its licensors. You may not reproduce, modify, or distribute HYX’s intellectual property without prior written consent.
Data Deletion and Account Termination
You may request account or data deletion by contacting support@hyxpro.com. Upon confirmation, we will delete or anonymise personal data unless retention is required by law. HYX may also deactivate inactive accounts per our Privacy Policy.
Disclaimer of Warranties
HYX is provided “as is” and “as available”. We make no warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the fullest extent permitted by law:
- HYX and Use Case Labs Pvt. Ltd. are not liable for indirect, incidental, consequential, or punitive damages.
- Our total liability shall not exceed the amount (if any) you paid in the preceding six (6) months.
Indemnification
You agree to indemnify and hold harmless Use Case Labs Pvt. Ltd., its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of HYX or violation of these Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Delhi, India.
Anti-Scraping and Unauthorized Data Access
You agree not to use bots, crawlers, or automated scripts to collect or extract data from HYX. Unauthorised aggregation, resale, or redistribution of HYX data is prohibited. Legal action may be taken against violators.
Changes to These Terms
Notification of Changes: We may update these Terms from time to time. Material changes will be notified through the app, email, or other means.
Acceptance of Changes: Continued use of HYX after updates constitutes acceptance. You must agree to updated terms to continue using the service.
Entire Agreement
These Terms, together with our Privacy Policy, form the entire agreement between you and Use Case Labs Pvt. Ltd. regarding your use of HYX and supersede any prior agreements or communications.

These Terms apply in addition to any applicable third-party platform terms (including Apple App Store terms), which govern payment processing and subscription management.
